Terms of Service

Please read these Terms of Service carefully before using the BrokerFlats platform. These terms govern your access to and use of our services.
1. Acceptance of Terms
By accessing or using BrokerFlats (brokerflats.com or our mobile applications), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our platform. These terms constitute a legally binding agreement between you and BrokerFlats Technologies Pvt. Ltd., a company incorporated under the Companies Act 2013, with its registered office in Mumbai, Maharashtra.
2. Eligibility
You must be at least 18 years of age to use BrokerFlats. By using our platform, you represent that you are legally capable of entering into binding contracts under Indian law.
3. User Accounts
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@brokerflats.com of any unauthorised access to your account. BrokerFlats is not liable for losses resulting from unauthorised use of your account.
4. Broker Listings
Brokers who list properties on BrokerFlats represent and warrant that: • They have the legal right or authorisation to list the property • All information provided is accurate, current, and not misleading • The property is not subject to any undisclosed legal disputes or encumbrances • Listing fees (where applicable) are non-refundable after the listing goes live BrokerFlats reserves the right to remove any listing that violates these terms without prior notice.
5. Prohibited Conduct
You may not: • Post false, misleading, or fraudulent listings • Scrape, crawl, or harvest data from our platform without written permission • Use our platform for any unlawful purpose • Attempt to gain unauthorised access to our systems • Engage in spamming, phishing, or harassment of other users or brokers • Circumvent any technical measures we use to protect our platform
6. Intellectual Property
All content on BrokerFlats — including text, images, logos, software, and design — is owned by or licensed to BrokerFlats Technologies Pvt. Ltd. You may not reproduce, distribute, or create derivative works without our prior written consent.
7. Disclaimer of Warranties
BrokerFlats provides the platform on an "as is" and "as available" basis. We do not guarantee: • The accuracy or completeness of any listing • That the platform will be uninterrupted or error-free • That any property transaction facilitated through our platform will close successfully We are a marketplace and are not a party to any transaction between buyers/renters and brokers/sellers.
8. Limitation of Liability
To the maximum extent permitted by law, BrokerFlats's total liability for any claim arising out of or related to these terms shall not exceed the greater of ₹500 or the amount you paid to BrokerFlats in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
9. Indemnification
You agree to indemnify and hold harmless BrokerFlats, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
10. Governing Law & Disputes
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. We encourage amicable resolution — before initiating legal proceedings, please contact us at legal@brokerflats.com.
11. Modifications
We may update these terms from time to time. We will notify registered users of material changes by email at least 30 days before they take effect. Your continued use of BrokerFlats after the effective date constitutes acceptance of the updated terms.
